Prescription Drug Affordability Act in Effect in 2026

The price of prescription medications is a topic of concern for many folks we work with day to day. Prescription drug costs have continued to rise over the years, but new measures in Illinois aim to address these concerns. The Illinois Prescription Drug Affordability Act took effect on January 1, 2026, which introduced new rules to make prescription pricing more transparent. While the law doesn't set price caps on medications, it aims to help keep costs down for consumers by regulating pharmacy benefit managers (PBMs).

Most folks have never heard of a PBM, but they play a major role in how your prescription drug benefits work. PBMs act as the middleman between health insurance companies, drug manufacturers, and pharmacies. They negotiate drug prices, determine which medications are covered by your insurance, and help manage pharmacy networks. While PBMs can help lower costs, some of their business practices have also been criticized for making prescription pricing confusing and driving up costs for patients.

The new laws set by the Drug Affordability Act limit several PBM practices that have come under criticism over the past several years. Beginning in 2026, PBMs can no longer steer patients toward pharmacies they own or have a financial interest in, use "spread pricing," where they charge health plans more than they reimburse pharmacies and keep the difference. They are also no longer allowed to keep certain manufacturer rebates instead of passing those savings along as required under the law, or restrict access to covered medications by improperly classifying them as specialty drugs.

While you probably won't notice dramatic changes overnight, the law is intended to make the prescription drug system work more fairly over time. The Prescription Drug Affordability Act is one step toward making prescription medications more affordable and accessible for Illinois residents. While it won't eliminate high drug prices on its own, it increases oversight of the companies that manage prescription benefits and aims to ensure that savings are more likely to reach patients rather than get lost behind the scenes.
